Terms of Service

Plain English. The legal version is the same idea — we just wrote this so you can actually read it.

1. Who we are

LoopMenu is operated by LoopMenu, Inc., a Delaware corporation. When this page says "we," "us," or "LoopMenu," that's who we mean. LoopMenu operates as an Independent Software Vendor (ISV), providing ordering, loyalty, and marketing technology to independent restaurant owners and the customers who order from them.

2. What LoopMenu does

LoopMenu lets restaurants run their menu, take direct orders at 0% commission, reward repeat customers, and connect with their customers through SMS, email, and social marketing. Customers use the LoopMenu app (called Menu) to browse menus, place orders, tap NFC cards or scan QR codes at the table, and earn loyalty points.

LoopMenu is free for restaurants to get started. We make money on optional paid marketing plans (Spark, Grow, Scale), branded NFC and QR card kits, and pay-as-you-go messaging packs. You are never required to purchase any paid plan to use the core ordering platform.

4. Orders & payments

When you place an order through LoopMenu, the restaurant — not LoopMenu — is the seller of the food. LoopMenu processes payment on the restaurant's behalf and routes the order to their kitchen. The restaurant is responsible for the accuracy, quality, and fulfillment of the food you ordered.

Some LoopMenu-run programs — such as marketplace deals, subscription plans, and branded NFC kits — are sold directly by LoopMenu, Inc. These are clearly labeled at checkout.

Refunds, cancellations, and order accuracy disputes are handled by the restaurant for restaurant orders, and by LoopMenu directly for LoopMenu-sold products and services.

5. Loyalty points

Points earned through the LoopMenu loyalty program have no cash value, cannot be transferred to another account, and may expire if your account is inactive for 12 consecutive months. We reserve the right to adjust point balances to correct technical errors, fraud, or abuse.

8. Content you post

Menus, photos, reviews, and other content you post remain yours. By posting content through LoopMenu you grant us a non-exclusive, royalty-free license to display, store, and promote that content so the platform functions correctly — for example, showing a restaurant's menu to customers who scan an NFC card.

You are responsible for ensuring that any content you post does not infringe the intellectual property rights of others.

9. We can change or stop the service

LoopMenu is actively being built and improved. Features can change, be added, or be removed. We can suspend or terminate accounts that violate these terms. We will provide reasonable notice for significant changes that affect your use of the platform.

10. No warranty / liability cap

LoopMenu is provided "as is" without warranties of any kind, express or implied. We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total liability to you for any claim arising from your use of LoopMenu is capped at the amount you paid LoopMenu in the 12 months preceding the claim — or $100, whichever is greater. Some states do not allow these limitations, in which case they apply to the maximum extent permitted by applicable law.

11. Governing law & disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of LoopMenu will be resolved in the state or federal courts located in Delaware, unless your local consumer protection laws provide otherwise.

12. SMS messaging

If you provide a mobile phone number, LoopMenu may send you SMS messages for transactional and — with your separate consent — marketing purposes. See our SMS Terms for full details on message types, frequency, opt-in, opt-out, supported carriers, and message & data rates.

The exact disclosure shown at checkout next to the phone number field reads:

"By providing your phone number, you consent to receive order confirmation and status updates via SMS from LoopMenu. Message and data rates may apply. Reply STOP to opt out at any time."

Marketing SMS requires a separate, unchecked-by-default opt-in and is never a condition of completing your order. Reply STOP to any message to unsubscribe. Reply HELP for support.
